Information on personal data protection

Information on personal data processing pursuant to Article 13 of Legislative Decree no. 196/2003 and following the entry into force of EU Regulation no. 679/2016

The protection of your privacy is one of our main objectives.

Access to certain sections of the Website/APP www.Voxfarm.com (hereinafter the "Site") and/or any requests for information or services by users of the Site/APP may be subject to the submission of personal data.

Pursuant to Art. 13 of EU Regulation no. 679/2016 (General Data Protection Regulation or "GDPR"), any individual who comes into contact with Our Company by communicating or providing their personal data (the "Data Subject") must be informed about the possession and processing of personal data by Voxfarm S.r.l., with registered office in Rome (RM), Via dei Monti di Pietralata, 16, 00157 as the Data Controller (the "Controller").

It is therefore necessary that the Data Subject - before providing their personal data upon registration on the Site/APP - reads this information notice.

1 – Source of personal data

Personal data is collected by the Controller directly from the Data Subjects, or provided by them on a voluntary basis in relation to the services and performance requested, for example at the time of registration in the reserved web area prepared by the Controller, through the compilation of online forms for participation in initiatives or for the acquisition of further information on the Controller's activity.

2 - Purposes of processing

According to the needs from time to time expressed by the user who accesses the various sections of the Site/APP (and except for specific rules and information for individual operations that involve the provision of specific personal data, published from time to time on the Site/APP), below are the purposes of processing personal data, i.e. those provided directly by users by filling in online forms, or through the use of social networks (see the following section "Nature and methods of providing Personal Data of users") or those acquired automatically (see the following section "Categories of Personal Data subject to processing").

Therefore, the Controller informs that the processing of personal data will be carried out with the following purposes:

  1. allow registration on the Site/APP, which is necessary for access to particular sections of the Site/APP itself and for providing and managing the various services offered; by the Controller and allow users to publish Contributions directly on the Site/APP, or on sites independently managed by third parties with which Voxfarm may have reached agreements in this regard, such as, by way of example and not limited to, social networks such as Facebook, Twitter, Instagram, etc. (hereinafter "Social Networks"); the publication of Contributions could also take place together with a pseudonym ("nickname") chosen by the user during registration on the Site/APP, and possibly with the image associated by the user with their nickname for which: i) the user will be solely responsible for any choice that would prejudice the interests of third parties; ii) the user is not required to use personal data that would allow third parties other than Voxfarm to identify them, but the user, through Voxfarm, could also disclose their own personal data if they have included them in their nickname, as well as the photo that they may have associated with their profile.
  2. fulfillment of legal, regulatory obligations or those required by EU legislation, including provisions issued by Authorities legitimated by law and/or by Supervisory and Control Bodies;
  3. fulfillment and execution of pre-contractual relationships (for example to respond to user requests in relation to Voxfarm products, advertising, or the Site/APP - "Contacts" section of the Site/APP, or to participate in initiatives organized by the Controller) and contractual relationships (for example to execute e-commerce purchases on the site, also for relationships with suppliers of goods and services and commercial partners for purposes related to the performance of activities aimed at fulfilling the services and providing the performance or goods by the Controller;
  4. fulfillment of administrative, management and accounting activities;
  5. development of commercial, advertising and marketing activities, also through direct marketing practices, such as market research, commercial information, customer satisfaction surveys, telemarketing, automated calling systems, without the intervention of an operator, mail including electronic mail, telefax and messages such as MMS (Multimedia Message Service) and SMS (Short Message Service), computer applications (APP), in the reserved area of the website, or through social networks;
  6. communication to third parties, such as suppliers and commercial partners, of personal data for marketing purposes, including through direct marketing practices, and commercial purposes;
  7. purposes of profiling site users, in order to personalize the experience of users on the Site/APP and improve services and products offered by Voxfarm to its customers, detect users' personal preferences and send them information, including commercial information, that better responds to their interests, using the information provided by them at the time of registration, or when filling out questionnaires or based on actions taken or information provided during navigation on the Site/APP

3 – Legal basis for processing and provision of data. Withdrawal of consent to processing

For the purposes described above, the legal basis that legitimizes the processing is the consent of the data subject pursuant to Art. 6, paragraph 1, letter "a" of the GDPR, documented in written form. For some types of processing, the legal basis that makes the processing legitimate may be constituted by the need to fulfill and execute a contract to which the data subject is a party, or pre-contractual measures adopted at the request of the data subject (Art. 6, paragraph 1, letter "b" GDPR), or even by the fulfillment of legal obligations to which the Data Controller is subject (Art. 6, paragraph 1, letter "c" GDPR).

The provision of data, when they are acquired on the basis of a legal obligation or as strictly functional to the execution of the pre-contractual and contractual relationship, is necessary and any refusal to provide them entails the impossibility of carrying out the activities required for the conclusion and execution of the contract, services and performance provided by the Controller, including through third parties.

Consequently, the Data Subject, with the signature affixed at the bottom of this information notice and/or with the express acceptance of this information notice presented through the Controller's web service, expresses their consent to the processing of data for the purposes indicated above (cf. paragraph 2, nos. 1-4).

In this regard, it is mandatory to provide the data whose fields are marked with an asterisk, so that Voxfarm can meet the user's needs within the functionality of the Site/APP. The failure, partial or inaccurate provision of Personal Data marked with an asterisk, as necessary for the execution of the requested service, does not make such execution possible.

For the sole purposes of marketing (cf. paragraph 2, no. 5), communication to third parties for marketing and commercial purposes (cf. paragraph 2, no. 6) and profiling (cf. paragraph 2, no. 7), consent to processing is not mandatory, but optional and subject to the express and specific consent of the data subject. Therefore, any refusal to provide it does not prejudice legal obligations, services and pre-contractual and contractual services with the Controller.

The provision of Personal Data can take place: a) by filling in the appropriate fields in the various sections of the Site/APP; or b) by automatic compilation, thanks to the data subject's request to a Social Network to which they are registered to communicate to Voxfarm some of the data that the data subject has already provided to the Social Network; in the latter case, Voxfarm recommends paying attention to the following:

  1. by selecting the link that allows registration through a Social Network, present on the Site/APP or on one of Voxfarm's pages on the Social Network, a window will appear containing a box to accept the communication of Personal Data from the Social Network to Voxfarm and three links to select:
    1. to read this information notice;
    2. for the list of personal data from time to time mandatory or optional, according to the specific purpose of processing;
    3. for the list of data that the Social Network is about to communicate to Voxfarm;
  2. the user, after reading the information notice, selecting the box with which they declare to be of legal age and learning which data must be provided, can select the link referred to in point c) above to deselect those data that they do not wish to provide to Voxfarm through the communication of the same by the Social Network. Both in the case of providing Personal Data by filling in the appropriate fields, and in that of automatic compilation thanks to the Social Network, if the user has omitted to provide one or more mandatory data, an error message from Voxfarm will appear with the list of missing mandatory Personal Data.

Withdrawal of consent to processing

The Data Subject has the right to withdraw consent to data processing, if the legal basis for processing is constituted exclusively by the consent of the Data Subject (for example for marketing purposes (cf. paragraph 2, no. 5), communication to third parties for marketing and commercial purposes (cf. paragraph 2, no. 6), and for those with profiling purposes - cf. paragraph 2, no. 7).

This right does not exist if the processing takes place in execution of legal obligations or for the execution of pre-contractual, contractual obligations or relationships aimed at providing services or performance by the Controller to the Data Subject (paragraph 2, nos. 1-4).

In any case, any withdrawal of consent does not affect the lawfulness of the processing based on the consent given before the withdrawal.

4 - Categories of processed data

The categories of processed data consist of common, identifying data (such as name, surname, postal address, email address, password, age, date of birth, sex, image, profession, marital status, etc.), contained in the forms and online forms, or in communications sent by the Data Subjects during their relations with the Controller and for their execution, or for the use of the related services and performance.

In addition to the Personal Data provided directly by users during connection to the Site, the computer systems and software procedures responsible for the operation of the Site itself administer and/or automatically and indirectly acquire some information that could constitute personal data, whose transmission is implicit in the use of Internet communication protocols (such as, by way of example but not limited to, so-called "cookies" (as better specified below), "IP" addresses, domain names of computers used by users connecting to the Site, addresses in "Url" notation of the requested resources, the time of the request to the server).

Information regarding the collection and use of cookies (Cookie policy) by Voxfarm is reported below.

5 - Processing methods

The data will be processed, respecting the necessary security and confidentiality, for determined, explicit and legitimate purposes, will be relevant, updated and not excessive in relation to the purposes listed above for which they are collected and may be used in further processing operations in terms compatible with such purposes. The processing will be carried out manually and with the aid of electronic and automated tools (including the collection of data by telematic means, directly from the Data Subject).

6 - Categories of recipients to whom personal data may be communicated

Personal data may be communicated to the following categories of subjects, who will process them as autonomous Data Controllers, or as Data Processors or persons in charge of their competence processing appointed by the Controller:

  1. service providers and commercial partners chosen by the Controller who, in this case, will take care of the relative processing, without disseminating the data;
  2. specifically appointed persons such as consultants, employees and other collaborators authorized for the processing necessary or connected to the performance of pre-contractual and contractual activities and in any case connected to the services and performance rendered by the Controller, also through third parties;
  3. third parties who perform or provide specific services strictly functional to the execution of the pre-contractual, contractual relationship (e.g. for sales through e-commerce), or of the services and performance rendered by the Controller (also through continuous processing) towards the Data Subject, such as IT and cloud computing service companies; banks and companies that provide payment services; agents; companies that deliver and logistics services, professional firms that provide assistance, tax, legal or administrative consulting; debt collection companies and lawyers appointed to follow debt collection procedures or litigation; correspondence printing and enveloping companies; any auditors.
  4. inspection bodies responsible for verifications and controls relating to the regularity of legal obligations, to which data may be communicated following inspections, verifications and controls. The data are not subject to dissemination or transfer to third countries or international organizations.

7 - Retention times

Personal data, including sensitive or judicial data, will be kept for 10 (ten) years, from the termination of the contractual relationship with the Data Subject. If the Data Subject has provided data for the purpose of participating in promotional or commercial or charitable initiatives that do not involve the stipulation of a contractual relationship, the data will be kept for the shorter duration of 5 years from the provision of the data. In any case, the possibility of their further conservation in fulfillment of any legal obligations or for the protection of rights in court is reserved. Personal data may be deleted even before this period if they are no longer necessary for contractual, administrative, tax, accounting or legal obligations.

8 - Existence of an automated decision-making process

There is no automated decision-making process.

9 – Rights of the data subject

The Data Subject may at any time exercise the rights reserved to them and in particular the following:

  • the right to ask the Data Controller for access to personal data (Art. 15 GDPR);
  • the right to rectification and integration of personal data (Art. 16 GDPR);
  • the right to erasure of personal data (right to be "forgotten"), in the cases provided for by Art. 17 GDPR;
  • the right to request the restriction of processing of personal data, in the cases and with the methods provided for by Art. 18 GDPR;
  • the right to data portability, according to the provisions of Art. 20 GDPR;
  • the right to object to the processing of personal data in the cases provided for by law;
  • the right to withdraw consent to processing (see paragraph 3);
  • the right to lodge a complaint with a supervisory authority, specifically with the Data Protection Authority.

At the request of the Data Subject, the Data Controller provides a copy of the personal data being processed. In case of further copies requested by the Data Subject, the Data Controller may charge a reasonable fee based on administrative costs. If the data subject submits the request by electronic means, and unless otherwise indicated by the data subject, the information is provided in a commonly used electronic format.

COOKIES

This site uses technical cookies, i.e. small files stored on the computer's hard drive that serve to provide services and/or information. Technical cookies are those used for the sole purpose of "carrying out the transmission of a communication on an electronic communications network, or as strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide this service" (see Article 122, paragraph 1, of the Code regarding the protection of personal data).

They are not used for further purposes and have been installed directly by the owner or manager of the website. They can be divided into browsing or session cookies, which guarantee normal navigation and use of the website (allowing, for example, to make a purchase or authenticate to access reserved areas). The prior consent of users is not required for the installation of such cookies.

Most cookies are "session cookies" and are therefore deleted from the hard drive at the end of the session (when you log out or close the browser).
